In juni 2015 verscheen het rapport van de Onderzoekscommissie strafrechtelijke beslissingen Openbaar Ministerie naar aanleiding van de zaak Bart van U., ook bekend als het rapport van de commissie Hoekstra.
Dit rapport bevatte onder andere de aanbeveling om voortaan reeds bij de inverzekeringstelling van een verdachte steeds celmateriaal af te nemen ten behoeve van het bepalen van het DNA-profiel na (eventuele) veroordeling. In opdracht van het (toenmalige) ministerie van Veiligheid en Justitie is door de Rotterdamse vaksectie strafrecht de juridische haalbaarheid en wenselijkheid van deze aanbeveling onderzocht. De aanbeveling is bezien in het licht van diverse gronden mensenrechten, strafvorderlijke uitgangspunten en regels van gegevensbescherming. Ook is het recht van enkele andere landen ter zake geschetst. De onderhavige uitgave bevat de weergave van dit onderzoek.
De conclusie van het onderzoek is dat het afnemen en bewaren van celmateriaal bij iedere in verzekering gestelde verdachte ten behoeve van het na (eventuele) veroordeling bepalen en verwerken van zijn DNA-profiel met het oog op toekomstige strafvervolgingen, juridisch nauwelijks houdbaar is. Door genoemd ministerie daarnaar gevraagd, heeft de Afdeling advisering van de Raad van State in het najaar van 2016 de uitkomst van het onderzoek onderschreven. Aangezien is gebleken dat de onderzoeksbevindingen voor de verdere discussie over de uitvoering van het rapport van de genoemde commissie onverminderd van belang zijn, is het onderzoeksrapport in 2018 alsnog separaat gepubliceerd. Er is van de gelegenheid gebruik gemaakt enige tekstuele verbeteringen door te voeren.
